(1) In this
section —
“licensing officer” means an officer
appointed under section 25 for the purposes of this Part.
(2) A licensing
officer may —
(a)
enter at any reasonable time any place specified in a licence as a place at
which a child care service may be provided and inspect that place and any
equipment or other thing at that place;
(b)
require any person who is at a place entered in accordance with this section
to provide any information that is necessary for the purpose of investigating
compliance with the licence or the regulations; and
(c)
inspect and for that purpose require the production of, any register, record
or other document that any person is required by the regulations to keep and
copy or take extracts from any such register, record or other document.
(3) A person must not,
without lawful excuse, fail to comply with a requirement under
subsection (2)(b) or (c).
Penalty: $6 000.
(4) If a magistrate is
satisfied by evidence on oath that there are reasonable grounds to suspect
that a child care service is being provided at a place other than a place at
which such a service may be provided under a licence, the magistrate may issue
a warrant to a licensing officer or a police officer authorising the officer
to enter and inspect that place.
