Sections 145 and 146
are repealed and the following sections are inserted instead —
“
145. Aiding a person to escape from lawful
custody
(1) In this
section —
“prison” includes any place where a
person is or may be held in lawful custody.
(2) A person who
conveys anything or causes anything to be conveyed into a prison with intent
to facilitate the escape of a person from that or another prison is guilty of
a crime and is liable to imprisonment for 7 years.
Summary conviction penalty: imprisonment for 3
years and a fine of $36 000.
(3) A person who aids
a person in escaping or attempting to escape from lawful custody is guilty of
a crime and is liable to imprisonment for 7 years.
Summary conviction penalty: imprisonment for 3
years and a fine of $36 000.
146. Escaping from lawful custody
A person who escapes
from lawful custody is guilty of a crime and is liable to imprisonment for 7
years.
Summary conviction penalty: imprisonment for 3
years and a fine of $36 000.
