(1) Subject to
subsections (2) and (3), the Board is to cancel the registration of
and direct the registrar to remove from the register the name of a podiatrist
if the Board is satisfied that the podiatrist —
(a) has
not practised podiatry in the preceding period of 5 years; and
(b) has
not maintained current knowledge and skills in podiatry at an approved level.
(2) If the Board
proposes to give a direction under subsection (1), the Board is to give
the podiatrist written notice of the proposal and the reasons for the
proposal.
(3) A notice given
under subsection (2) must state that within 28 days after the notice
is given, the podiatrist to whom it is given may make written representations
to the Board concerning the proposal, and the Board is not to give the
direction without considering any representations received within that period.
