(1) In this
section —
compensable injury means an injury to a worker
that is a personal injury by accident in respect of which permanent impairment
compensation under this Division has been paid or is payable to the worker.
(2) If a worker has,
by a compensable injury, suffered a permanent impairment described in column 1
of the Table to section 101 and by a subsequent compensable injury
suffers further permanent impairment of the same body part or
faculty —
(a) the
amount of permanent impairment compensation payable for that further
impairment is the amount that is proportionate to any increase (resulting from
that subsequent compensable injury) in the degree of permanent impairment; and
(b) the
amount of permanent impairment compensation payable for each further
impairment must be calculated on the basis of the permanent impairment
compensation amount applying on the day on which each subsequent compensable
injury occurred.
