(1) An arbitrator may
determine a dispute about any of the following matters ( hearing loss matters
) concerning hearing loss suffered by a worker —
(a) the
results of an NIHL assessment of the worker;
(b) the
extent of hearing loss suffered by the worker;
(c)
whether and to what extent hearing loss suffered by the worker is
noise-induced hearing loss.
(2) A hearing loss
matter cannot be disputed except on the basis of evidence provided by an NIHL
assessment.
