(1) A claim for
compensation under this Division must be made within 12 months after the
date of the worker’s death.
(2) A claim may be
made on the employer by, or on behalf of, a claimant.
(3) Compensation for
2 or more claimants can be the subject of a single claim.
(4) A claim must be
made in the approved form and must be accompanied by supporting information
and documents required by the approved form.
(5) A failure to make
a claim for compensation within the period required by subsection (1) or
a defect or inaccuracy in the claim form or details of the claim does not
invalidate the claim if —
(a) the
failure, defect or inaccuracy results from mistake, absence from the State or
another reasonable cause; or
(b) the
failure, defect or inaccuracy would not prejudice the employer’s defence
in proceedings that might arise out of the claim.
