This Division does not
apply to an employer who is a public authority on behalf of which the
Insurance Commission manages and administers insurance arrangements in
relation to compensation liability in respect of a declared act of terrorism.
(1) In this
Division —
act of terrorism means a dangerous action or
threat of a dangerous action, if the dangerous action is done or the threat is
made with the intention of advancing a political, religious or ideological
cause and with the intention of —
(a)
coercing, or influencing by intimidation, the government of a State, the
Commonwealth or a foreign country or of part of a State or foreign country; or
(b)
intimidating the public or a section of the public.
(2) A dangerous action
is an action that has 1 or more of the following results (each a
dangerous result ) —
(a)
causes serious harm that is physical or psychological harm to a person;
(b)
causes serious damage to property;
(c)
causes a person’s death;
(d)
endangers a person’s life, other than the life of the person taking the
action;
(e)
creates a serious risk to the health or safety of the public or a section of
the public.
(3) Advocacy, protest,
dissent or industrial action is not a dangerous action if it is not intended
to have any dangerous result.
