(1) The Minister may
by order published in the Gazette declare an action or threat of an action
that the Minister is satisfied is an act of terrorism to be a declared act of
terrorism for the purposes of this Act.
(2) The declaration
must identify the declared act of terrorism with sufficient particularity to
enable a person to know whether a claim for compensation by the person might
be affected by the declaration.
(3) The declaration
must specify the day on which the declared act of terrorism must be treated,
for the purposes of this Act, as having occurred.
(4) This Division
extends to a compensation liability in respect of a declared act of terrorism
that was incurred before the declaration of the declared act of terrorism.
(5) An order under
subsection (1) is not subsidiary legislation for the purposes of the
Interpretation Act 1984 .
