(1) A person is
excused from answering a question, providing information or producing a
document or other thing in a proceeding if the person could not be compelled
to answer the question, provide the information or produce the document or
other thing in proceedings in the Supreme Court, unless it would be contrary
to —
(a)
section 372; or
(b)
section 373; or
(c) an
order under section 341(1).
(2) A conciliator or
arbitrator may require a person to produce a document or other thing for the
purpose of determining whether or not it is a document or thing that the
conciliator or arbitrator has power to require the person to produce in the
proceeding.
