(1) In this
Part —
damages —
(a)
means damages due or payable to, or claimed by, a worker for an injury
caused to that worker by the tort of another person; but
(b) does
not include —
(i)
any sum required or authorised to be paid under an award
or industrial agreement as those terms are defined in the
Industrial Relations Act 1979 section 7(1); or
(ii)
any sum payable under a superannuation scheme or any life
or other insurance policy; or
(iii)
any amount paid in respect of costs incurred in
connection with legal proceedings;
third party means a person other than the
employer;
tort means negligence or other tort or breach of
statutory duty.
(2) This Part applies
to damages for a tort even if the damages are sought to be recovered in an
action for breach of contract or other action.
