(1) WorkCover WA must
have a common seal.
(2) A document is duly
executed by WorkCover WA if —
(a) the
common seal of WorkCover WA is applied to it in accordance with
subsections (3) and (4); or
(b) it
is signed on behalf of WorkCover WA by a person or persons authorised to do so
under subsection (5).
(3) The common seal of
WorkCover WA must not be applied to any document except as authorised by
WorkCover WA.
(4) The common seal of
WorkCover WA must be applied to a document in the presence of any 2 Board
members, each of whom must sign the document to attest that the common seal
was so applied.
(5) WorkCover WA may,
by writing under its common seal, authorise any of the following persons to
sign documents on behalf of WorkCover WA, either generally or subject to the
conditions that are specified in the authorisation —
(a) a
Board member or Board members;
(b) a
staff member or staff members.
(6) A document
purporting to be executed in accordance with this section must be presumed to
be duly executed unless the contrary is shown.
(7) When a document is
produced bearing a seal purporting to be the common seal of WorkCover WA, it
must be presumed that the seal is the common seal of WorkCover WA unless the
contrary is shown.
