(1) If the office of
an appointed member becomes vacant because the member’s term of office
expires by effluxion of time, the appointed member continues to be an
appointed member during that vacancy until the day on which the vacancy is
filled (whether by reappointment of the member or appointment of a successor
to the member).
(2)
Subsection (1) ceases to apply if the member resigns or is removed from
office under section 455(6).
(3) The maximum period
for which an appointed member continues to be an appointed member under this
section after the member’s term expires is 3 months.
