(1) A person must not
provide false or misleading information —
(a) in,
or in connection with, an application made or a notice or other document given
under this Act; or
(b) in
compliance, or purported compliance, with a requirement under this Act; or
(c) for
any other purpose under this Act.
Penalty for this subsection: a fine of
$15 000.
(2) For the purposes
of subsection (1), a person provides false or misleading information if
the person —
(a)
makes a statement that the person knows is false or misleading in a material
particular; or
(b)
omits from a statement made by the person anything without which the statement
is, to the person’s knowledge, misleading in a material particular; or
(c)
gives information that —
(i)
the person knows is false or misleading in a material
particular; or
(ii)
omits anything without which the information, to the
person’s knowledge, is misleading in a material particular.
